Welcome to Faraway Garden. We are a small, independent food business based in the Netherlands, making chocolate and other treats in small batches. These terms apply to purchases made through our website.

2. Our products
Our chocolate and confectionery are handmade in small batches. Because our products are handmade, small variations in appearance, colour, texture and shape can occur between batches.
Our product photographs are intended to give a good representation of our products, but the appearance of individual handmade products may vary slightly.
We make every effort to ensure that product descriptions, ingredients and allergen information are accurate and up to date.
Because our chocolate is made in micro-batches, some products may have limited availability and may sell out.
3. Prices
All prices displayed on our website are in euros and include VAT where applicable.
Delivery charges are shown separately before you complete your order.
The total price, including any applicable delivery charges, will be shown before payment.
4. Ordering and payment
When you place an order through our website, you are making an offer to purchase the products in your basket.
Your order is accepted once payment has been successfully received and we have sent you an order confirmation.
The final order summary will show the products ordered, the total price and applicable delivery costs.
The checkout button will clearly indicate that placing the order involves an obligation to pay.
5. Delivery
We currently deliver online orders to addresses within the Netherlands only.
Chocolate orders are shipped every Monday at 15:00.
Orders placed after 15:00 on Monday will be shipped the following Monday.
Once your order has been dispatched, you will receive available tracking information.
Delivery times are estimates and are dependent on the delivery service. We cannot guarantee an exact delivery date or time.
If your order has not arrived within a reasonable period, please contact us so that we can investigate the delivery.
6. Chocolate and temperature
Chocolate is sensitive to temperature.
We recommend storing your chocolate in a cool, dry place at approximately 15–18°C, away from direct sunlight, moisture and strong smells.
During warm weather or periods of temperature fluctuation, chocolate may soften or develop chocolate bloom. This can affect its appearance or texture but does not necessarily mean that the chocolate is unsafe to eat.
We take care when packing chocolate for delivery, but storage conditions after delivery are outside our control.
7. Fresh bakes and market-only products
Fresh bakes and particularly fresh products, including products such as scones, are available only at our market stalls unless otherwise stated.
Please follow any storage instructions and best-before information supplied with your products.
8. Allergens
Ingredients and allergen information are provided with our products and/or on the relevant product page.
Our products are made in an environment where different allergens are present. For this reason ours products are not reccomended for those suffering from allergies.
9. Right of withdrawal and returns
Consumers purchasing products online generally have a statutory 14-day right of withdrawal.
The withdrawal period normally begins on the day after the product is received.
Certain products are excluded from this right, including products that spoil quickly or have a limited shelf life. Whether an individual Faraway Garden product falls within an exception depends on the nature of that product.
Where the statutory right of withdrawal applies, you may cancel your purchase within the applicable period without giving a reason.
You may exercise your right of withdrawal using the withdrawal function provided on our website or by contacting us by email.
If you withdraw from an eligible purchase, the product must be returned within 14 days after notifying us.
Return postage is the customer’s responsibility where this has been clearly communicated before purchase and where permitted by law.
Where a refund is due, we will process it in accordance with applicable consumer law.
Nothing in these terms limits your statutory consumer rights.
10. Damaged, incorrect or missing orders
We carefully check and pack every order before it leaves Faraway Garden.
If your order arrives damaged, contains the wrong product, or an item is missing, please contact us as soon as possible and include your order number.
Photographs of the packaging and damaged product may help us resolve the problem quickly.
We will investigate the issue and, where appropriate, arrange a replacement, refund or other suitable solution in accordance with your statutory rights.
If a parcel is lost during delivery, please contact us. We will investigate the matter with the delivery service.
11. Complaints
If you are unhappy with your order or our service, please contact us as soon as possible.
We are a small business and genuinely value your feedback. We will do our best to resolve complaints fairly and promptly.
12. Chocolate Club – Coming Soon!
If you join the Faraway Garden Chocolate Club, the specific subscription price, contents, delivery frequency and cancellation arrangements will be clearly shown before you subscribe.
Any applicable statutory withdrawal and cancellation rights will apply.
If the Chocolate Club is offered as a recurring subscription, the renewal frequency and cancellation arrangements will be clearly explained before you sign up.
13. Product availability
Our chocolate is made in small batches and quantities are therefore limited.
We may occasionally sell out of a product before the website has been updated.
If a product you have ordered unexpectedly becomes unavailable, we will contact you and offer an appropriate solution, including a refund where applicable.
14. Changes to these terms
We may update these terms from time to time to reflect changes to our business, products or legal requirements.
The version applicable to your purchase is the version available on our website at the time you place your order.
15. Applicable law
These terms are governed by Dutch law.
Nothing in these terms affects mandatory consumer rights under applicable Dutch or European law.
